This policy explains how Calaca Digital collects, uses, shares and protects the personal data you give us through www.calacadigital.com (the «Site»), its forms and the contact channels shown on it. It follows Costa Rica’s Law No. 8968 on the Protection of Individuals regarding the Processing of their Personal Data and its Regulations.
This policy does not apply to data we process on behalf of our clients within the projects we build for them; in those cases, each client is responsible for its own databases and for informing its users.
1. Who is responsible for your data
Calaca Digital is responsible for the database that stores the data you give us through the Site. For any question about this policy or your data, write to formulario@calacadigital.com.
2. What data we collect
| Category | Data |
|---|---|
| Identity and contact | Name, email and, if you message us on WhatsApp or call us, your phone number. |
| Business information | Company name or website, the service you are interested in and the message you send. |
| Record of your consent | Date and time you accepted this policy and the page you wrote from. |
| Technical and browsing data | IP address, device and browser type, pages visited and interaction with the Site. Analytics and marketing data are only collected if you accept them in the cookie banner. |
We do not ask for sensitive data (for example, health, racial origin, religious beliefs or sexual orientation). Please do not include it in your messages.
3. How we obtain your data
- Directly from you: when you fill in the contact form, email us, message us on WhatsApp or book a call.
- Automatically: through cookies and similar technologies, according to your choice in the cookie banner. Details are in our Cookie policy.
4. What we use your data for
- To read and answer your request and schedule the diagnosis call.
- To prepare the X-ray, proposals and quotes you ask for.
- To communicate with you about the service you hired.
- To measure and improve how the Site works, only if you accept analytics cookies.
- To measure our ads, only if you accept marketing cookies.
- To keep the Site secure and prevent spam and fraud.
- To meet legal obligations and requests from competent authorities.
We do not sell your data. We will only send you newsletters or commercial messages if you give us separate permission, which you can withdraw at any time.
5. Your consent
By ticking the box on the form, you expressly authorize the processing of your data for the purposes in this policy. Giving us your data is voluntary; however, your name and email are required to reply to you: without them we cannot handle your request. You can withdraw your consent at any time, as explained in section 9.
6. Who we share your data with
To run the Site and serve you, we rely on providers that process data on our behalf and following our instructions: web hosting, email, spam filtering, analytics and ad measurement tools, messaging (WhatsApp) and tools to schedule calls and manage clients.
We do not hand your data to third parties for their own purposes without your prior consent, unless a law or a competent authority requires it.
7. International transfers
Some of our providers (for example, Google and Meta) store information on servers outside Costa Rica, mainly in the United States. We choose providers that apply recognized security measures. By accepting this policy, you authorize your data to be processed on those servers for the purposes described here.
8. How long we keep your data
- Contact requests that do not become a project: up to 24 months from the last contact, unless you ask us to delete them sooner.
- Clients: for the duration of the business relationship and, afterwards, for the period required by accounting, tax and commercial laws.
- Analytics data: according to the retention period set in the tool, never longer than 14 months.
When these periods end, we delete the data or anonymize it so it can no longer be linked to you.
9. Your rights
Under Law No. 8968, you can at any time:
- Access your data and learn how we process it.
- Rectify or update data that is incomplete or inaccurate.
- Request deletion of your data.
- Withdraw the consent you gave us.
- Receive clear information about how your data is processed.
To exercise them, email formulario@calacadigital.com with the subject «Privacy rights». Include your name, the right you want to exercise and how we can reply. If we need to confirm your identity, we will ask only for the minimum information necessary. We will answer free of charge and within the period set by Law No. 8968 and its Regulations.
Withdrawing consent does not affect processing carried out before the withdrawal. We may also need to keep some data when a legal obligation requires it.
If you believe we did not handle your request properly, you can file a complaint with Costa Rica’s data protection authority, the Agencia de Protección de Datos de los Habitantes (PRODHAB).
10. Security
We protect your data with encrypted connections (HTTPS), access limited to the people who need it, spam and bot filters, strong passwords and backups. No system on the internet is completely secure; if we detect an incident affecting your data, we will inform you and take the appropriate measures.
11. Minors
The Site is aimed at businesses and people over 18. We do not knowingly collect data from minors. If you are a parent or guardian and believe a minor gave us their data, write to us and we will delete it.
12. Cookies
We use necessary cookies to make the Site work and, only with your permission, analytics and marketing cookies. You can accept them, reject them or change your choice at any time from «Cookie settings» in the footer. More information in our Cookie policy.
13. Social media and external links
The Site links to our social media (Instagram and Facebook) and to WhatsApp. When you use them, those platforms process your data under their own privacy policies, which we recommend you read. If you message us through those channels, we will treat the information you share according to this policy.
14. Changes to this policy
We may update this policy when our services or the law change. The current version will always be on this page, with its update date. If the change is significant, we will let you know through the contact details we have.
